2. Scope

These Terms and Conditions ("T&Cs") apply to all services provided by JC Virtual Tour, whether concluded with businesses (B2B) or consumers (B2C) within the meaning of French consumer law.

Placing an order constitutes full and unreserved acceptance of these T&Cs. Where specific terms have been agreed in writing, those shall prevail over these T&Cs.

3. Services

JC Virtual Tour provides the following services:

  • 360° virtual tour scanning and creation (interior and exterior)
  • Hosting and publishing of the virtual tour
  • Website integration (embed code provided)

4. Orders and Contract Formation

All service requests are formalised by a quote sent by email. The contract is concluded upon receipt of the signed quote (or written confirmation).

JC Virtual Tour reserves the right to refuse any order for legitimate reasons, including prior disputes or requests incompatible with the provider's values and capacity.

5. Pricing

Prices are those shown on the website or in the quote sent to the client. They are expressed in euros (€) exclusive of tax. For sole traders not subject to VAT, invoices carry the note: "VAT not applicable — Art. 293 B of the French General Tax Code."

Prices may be changed at any time. All services are invoiced at the price in force on the date the confirmed order is placed.

6. Payment Terms

  • Accepted payment method: secure online payment via Stripe.
  • Deposit and balance conditions are specified in the quote.

Late payment automatically triggers, without prior notice, late payment interest at the statutory rate in force, plus a fixed recovery indemnity of €40 (Art. L441-10 of the French Commercial Code, applicable to B2B relationships).

7. Service Delivery

Delivery timescales stated in quotes are indicative. They may be amended in cases of force majeure or circumstances beyond the provider's control.

The client agrees to:

  • Provide access to the premises for scanning on the agreed date
  • Ensure spaces are ready (tidy, well-lit)
  • Provide any necessary authorisations for photography

8. Deliverables

The virtual tour is delivered via a URL hosted on JC Virtual Tour's servers (or a third-party provider). An embed code (iframe) is also provided for insertion on the client's website.

The hosting period included and renewal conditions are specified in the quote.

9. Right of Withdrawal (B2C consumers only)

In accordance with Articles L221-18 et seq. of the French Consumer Code, consumers have a period of 14 days from the conclusion of the contract to exercise their right of withdrawal, without needing to give any reason.

Exception: Pursuant to Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised where the service has been fully performed before the end of the 14-day period, provided performance began with the consumer's prior express agreement and the consumer expressly waived their right of withdrawal.

To exercise this right, the consumer must notify their decision by email to contact@jc-virtualtour.com before the deadline expires, using the model form below or any other unambiguous statement.

Model withdrawal form: "I hereby notify my withdrawal from the contract for the following service: [description], ordered on [date]. [First name, Last name, Address]."

Upon valid withdrawal, JC Virtual Tour will refund all sums paid within 14 days of receiving the notification.

The right of withdrawal does not apply to contracts concluded between businesses (B2B).

10. Intellectual Property

Raw source files remain the property of JC Virtual Tour. The client receives a non-exclusive licence to use the delivered virtual tour for the purposes defined in the quote (website, social media, etc.).

Any reproduction, resale or modification of the tour by the client without prior written consent is prohibited.

11. Liability

JC Virtual Tour undertakes to carry out its services with care and diligence. The provider's liability is limited to the amount of the relevant service and shall not cover indirect damages (loss of revenue, reputational harm, etc.).

JC Virtual Tour is not responsible for service interruptions caused by third-party hosting providers (Vercel, tour servers) or incompatibilities with the client's website or systems.

12. Force Majeure

Neither party shall be liable for failure to meet contractual obligations resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code (natural disaster, pandemic, strike, network outage, etc.).

13. Dispute Resolution

Business clients (B2B)

In the event of a dispute, both parties agree to seek an amicable resolution within 30 days. Failing this, the dispute shall be referred to the courts with jurisdiction over the provider's registered address.

Consumer clients (B2C)

In accordance with Article L616-1 of the French Consumer Code, consumers may refer disputes to a consumer mediator. In the absence of a sector-specific mediator, they may use the EU Online Dispute Resolution platform.

Failing amicable resolution, French courts shall have exclusive jurisdiction.

14. Governing Law

These T&Cs are governed by French law. Relations between JC Virtual Tour and consumer clients are governed by the French Consumer Code.
